Terms & Conditions
Version v1 · effective 2026-10-20 · Privacy Policy
1. About these terms
These Terms & Conditions ("Terms") govern your use of FlatOrbit, an online service for managing apartment communities, flats, owners, tenants, occupancy records and community accounts (the "Service"), operated by FlatOrbit, [Registered office address] ("we", "us"). By creating an account, accepting an invitation or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for an organization, you confirm you are authorised to accept these Terms for it.
2. Who uses FlatOrbit
- Organizations - resident welfare associations, apartment owners' associations, builders or property managers that subscribe to the Service ("Organization").
- Staff - administrators, property managers and maintenance staff an Organization invites.
- Owners and tenants - residents an Organization invites, and tenants who register a profile themselves.
Each Organization decides who it invites, what roles they hold, and what information it records about its community.
3. Accounts and security
- Give accurate information and keep it up to date. You must be at least 18 years old to hold an account.
- Keep your password secret and do not share your account. You are responsible for activity under your account.
- Tell us or your Organization's administrator promptly if you suspect unauthorised use. We may end sessions or suspend an account to protect it.
4. Organization responsibilities
An Organization that records information about owners, tenants or occupants is responsible for having a lawful basis to do so, giving them any notice the law requires, keeping the information accurate, and using it only to manage its community. For the personal data it enters, the Organization acts as the data fiduciary and we process that data on its behalf and on its instructions, as described in the Privacy Policy.
5. Acceptable use
You must not:
- upload anything unlawful, defamatory, or that you have no right to share, or identity numbers the Service does not ask for (for example Aadhaar numbers);
- try to see data outside the access you were given, probe or bypass security controls, or disrupt the Service;
- use the Service to harass, discriminate against or profile residents, or to send unsolicited messages;
- copy, resell or reverse-engineer the Service except as the law allows.
6. Subscriptions and fees
- Organizations subscribe to a plan with limits on properties, flats and staff users. Prices are as quoted to the Organization; billing is by invoice and payment outside the Service unless agreed otherwise. Fees are exclusive of applicable taxes (including GST).
- A trial ends on the date shown. When a subscription expires, the Organization keeps read-only access for 7 days; after that, staff sign-in for the Organization is blocked until it is renewed. Owners' and tenants' own access to their records is not blocked.
- We may change plans or prices for future terms with at least 30 days' notice. Fees already paid are non-refundable except where the law requires or we agree in writing.
7. Community accounts and payments
FlatOrbit helps an Organization record maintenance dues, payments, receipts and income and expenses. FlatOrbit does not collect, hold or transfer money. Payments are made directly between residents and the Organization. Receipts are issued by the Organization. The Organization is responsible for its accounts, any tax filings and statutory audits; the Service is a record-keeping tool, not accounting, tax or legal advice.
8. Your content
Information and documents you or your Organization put into the Service remain yours or theirs. You give us permission to host, process and display it only to provide the Service, keep it secure, and comply with the law. We do not sell personal data or use it for advertising.
9. Availability and changes
We aim to keep the Service available but do not guarantee it will be uninterrupted. We may carry out maintenance (announced in the Service where possible) and improve or change features. We keep regular backups, but Organizations should export records they must keep.
10. Suspension and termination
- You may stop using the Service at any time. An Organization may close its account by contacting us.
- We may suspend or close an account that breaches these Terms, endangers other users or the Service, or is unpaid, giving notice where reasonable.
- After closure, data is kept and deleted as described in the Privacy Policy. An Organization can request an export of its records before closure.
11. Intellectual property
The Service, its software, design and the FlatOrbit name and logo belong to us or our licensors. These Terms give you a limited, non-transferable right to use the Service while your account is active.
12. Disclaimers
The Service is provided "as is" and "as available". The records in it are entered by Organizations and users; we do not verify their accuracy, the identity of residents, or the validity of rental agreements, and the Service is not police verification or a legal tenancy register.
13. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential losses, or loss of profits or data, and our total liability for any claim relating to the Service is limited to the fees the Organization paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
An Organization will compensate us for claims by third parties arising from data it entered without a lawful basis or from its breach of these Terms.
15. Changes to these terms
We may update these Terms. For material changes we will give notice in the Service or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of India. Subject to any rights you have under consumer protection law, the courts at [City] have exclusive jurisdiction.
17. Contact and grievances
Questions: [email protected]. Grievance Officer: [Grievance Officer name], [email protected]. We acknowledge grievances within 24 hours and aim to resolve them within 15 days.
